One05 Sports Waiver & Liability Agreement
For youth participation in One05 Sports basketball skills clinics and related activities.
Important: By registering and paying for this clinic, the parent/legal guardian affirms they have read, understand, and agree to the terms below on behalf of themselves and the minor participant.
1) Definitions
“Participant” means the minor athlete participating in One05 Sports activities. “Parent/Guardian” means the adult registering the Participant. “Activities” include, but are not limited to: basketball drills, conditioning, scrimmages, demonstrations, warm-ups, instruction, and any related events conducted by One05 Sports, including time on premises before/after the clinic.
2) Assumption of Risk
Parent/Guardian understands that basketball and athletic activities involve inherent risks, including but not limited to: slips, falls, collisions, contact with other participants, overexertion, dehydration, heat illness, concussions, sprains/strains, fractures, and other serious injuries. Parent/Guardian voluntarily assumes all known and unknown risks on behalf of themselves and the Participant, including risks arising from the actions, inactions, or negligence of other participants.
3) Participant Fitness & Health Representation
Parent/Guardian represents that the Participant is physically able to participate in the Activities and has no condition that would make participation unreasonably dangerous. Parent/Guardian agrees to disclose relevant medical conditions, allergies, medications, and limitations to One05 Sports in advance when requested. Parent/Guardian acknowledges that One05 Sports is not providing medical advice.
4) Concussion & Head Injury Acknowledgment
Parent/Guardian understands the signs and symptoms of concussion and head injury and agrees that the Participant will be removed from participation if a concussion is suspected (by staff, Parent/Guardian, or the Participant). Parent/Guardian agrees the Participant will not return to participation the same day after a suspected concussion. Parent/Guardian acknowledges return-to-play decisions should be made by a licensed healthcare professional.
5) Medical Authorization
In the event of injury or illness, Parent/Guardian authorizes One05 Sports staff to obtain emergency medical care for the Participant, including first aid, emergency medical services (EMS), and transport to a medical facility when deemed necessary. Parent/Guardian agrees to be responsible for all costs associated with medical care and transportation. Parent/Guardian releases One05 Sports from liability for acting in good faith to secure such care.
6) Release of Liability
To the fullest extent permitted by law, Parent/Guardian (for themselves and on behalf of the Participant) releases, waives, and discharges One05 Sports, its owners, officers, directors, employees, contractors, volunteers, coaches, agents, representatives, sponsors, and the host facility (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, costs, and expenses arising out of or related to participation in the Activities, including claims arising from the negligence of any Released Party, except where prohibited by law.
7) Indemnification
Parent/Guardian agrees to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, and attorney’s fees arising from or related to (a) the Participant’s actions or omissions, (b) Parent/Guardian’s actions or omissions, or (c) breach of this Agreement.
8) Conduct & Safety Rules
- Parent/Guardian agrees the Participant will follow staff instructions and safety rules at all times.
- One05 Sports may remove any Participant whose behavior is unsafe, disruptive, or inappropriate without refund.
- No weapons, alcohol, tobacco, or illegal substances are permitted at Activities.
- Participants must wear appropriate athletic shoes and attire. Jewelry should be removed for safety.
9) Photography / Video / Media Release
Parent/Guardian grants One05 Sports permission to photograph, audio record, and/or video record the Participant during Activities and to use such media for lawful promotional purposes (website, social media, marketing materials) without compensation. Parent/Guardian understands that names will not be shared publicly without additional consent.
Optional Opt-Out: If you do not consent to media use, email Bobby@one05sports.com within 24 hours of registration with “MEDIA OPT-OUT” in the subject line and the Participant’s name.
10) Personal Property
Parent/Guardian acknowledges One05 Sports and the host facility are not responsible for lost, stolen, or damaged personal property. Please label items and avoid bringing valuables.
11) Attendance, Cancellation, and Refund Policy
Registration fees reserve a spot and are generally non-refundable. One05 Sports may offer a credit toward a future clinic if notice of inability to attend is provided at least [24/48] hours before the clinic start time. No-shows are not eligible for refund or credit. One05 Sports reserves the right to cancel or reschedule due to weather, facility issues, coach availability, or safety concerns. If One05 Sports cancels, Parent/Guardian will be offered a reschedule option or refund of the registration fee (excluding any non-refundable third-party processing fees, if applicable).
12) Facility-Specific Terms
Parent/Guardian agrees to comply with all facility rules, policies, and staff instructions. One05 Sports is not responsible for facility conditions, security staffing, or facility operations controlled by third parties.
13) Severability
If any part of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.
14) Governing Law & Venue
This Agreement will be governed by the laws of the State of Georgia, without regard to conflict of laws principles. Venue for any dispute will be in a court of competent jurisdiction in [Chatham County, GA / Your County], unless otherwise required by law.
15) Acknowledgment & Acceptance
Parent/Guardian acknowledges they have read and understand this Agreement and agree to its terms. Parent/Guardian understands this Agreement is intended to be as broad and inclusive as permitted by law. Acceptance is provided electronically at checkout when registering and paying for the clinic.
